Terms and Conditions of Use

1. Acceptance of the Terms
By accessing, registering for, or using the QuadraProfile platform (hereinafter, the "Platform"), operated by QP Quadra Profile SpA (hereinafter, "QP", "we", or "the Company"), domiciled in Santiago, Chile, you (hereinafter, the "User") acknowledge that you have read, understood, and fully accepted these Terms and Conditions of Use.
If you do not agree with any of the provisions set forth herein, please refrain from using the Platform. Continued use of QuadraProfile constitutes full acceptance of these terms and any future updates thereto.
2. Definitions
For the purposes of these Terms, the following definitions shall apply:
- Platform: The set of web applications, APIs, and services provided by QP under the QuadraProfile brand, including all associated subdomains and services.
- User: Any natural or legal person who accesses the Platform, whether as an administrator, operator, or any other role assigned within a Client Company.
- Client Company: The organization that contracts QuadraProfile's services for the assessment of candidates or employees within its internal processes.
- Candidate: The natural person who completes a DISC Test at the request of a Client Company through the Platform.
- DISC Test: The psychometric assessment based on the DISC model (Dominance, Influence, Steadiness, Conscientiousness) administered through the Platform.
- Report: The document generated by the Platform based on the DISC Test results, which includes the Candidate's behavioral profile analysis.
3. Registration and User Account
To use the Platform, the User must create an account by providing truthful, complete, and up-to-date information. The User agrees to:
- Accurate data: Provide accurate and truthful data at the time of registration and keep it up to date. Submission of false information may result in the suspension or cancellation of the account.
- Credential responsibility: Maintain the confidentiality of their password and access credentials. The User is responsible for all activity carried out under their account and must immediately notify QP of any unauthorized use.
- One account per person: Each natural person must maintain a single user account. Creating multiple accounts or sharing access credentials with third parties is not permitted.
4. Description of the Service
QuadraProfile is a SaaS (Software as a Service) platform specializing in personality assessments based on the DISC model. The service includes test administration, automated report generation, and human talent management tools.
AI-generated reports: Reports are generated using artificial intelligence models (Google Gemini) and are strictly advisory in nature. They do not constitute a clinical, psychological, or medical diagnosis. Reports must be interpreted by qualified professionals and should not be the sole determining factor in hiring, promotion, or any other decision affecting individuals.
Service availability: QP makes its best efforts to maintain the Platform available on a continuous basis. However, no specific service level agreement (SLA) is guaranteed unless an Enterprise plan with a written service level agreement has been expressly contracted. QP may perform scheduled maintenance with reasonable prior notice.
5. Plans and Payments
QuadraProfile operates under a prepaid test pack model. The commercial terms are as follows:
- Available packs: The Platform offers packs of 1, 10, and 100 tests, as well as customized plans for Enterprise clients. Current pricing is published in the Pricing section of the Platform.
- Validity: Purchased tests are valid for one (1) year from the date of purchase. After that period, unused tests will expire without the right to a refund.
- Payment method: Payments are processed through Transbank (Chile). QP does not store credit or debit card data; these are managed directly by the payment processor in accordance with its own security policies.
- No refund for used tests: Tests that have been consumed (i.e., sent to a Candidate) are non-refundable under any circumstances.
- Refund for unused tests: Unused tests may be refunded on a prorated basis, provided the request is submitted within the first thirty (30) calendar days from the date of purchase. After this period, refund requests will not be accepted.
6. Intellectual Property
Intellectual property rights are distributed as follows:
- Software and technology: All software, source code, algorithms, designs, interfaces, trademarks, logos, and Platform content are the exclusive property of QP Quadra Profile SpA or its licensors. Reproduction, modification, or distribution without prior written authorization is prohibited.
- Generated reports: The Client Company receives a limited, non-exclusive, non-transferable license to use the Reports generated under its subscription, solely for its internal human talent management purposes.
- Candidate data: Personal data provided by the Candidate is and shall remain the property of the Candidate. QP acts as a data processor in accordance with applicable legislation and our Privacy Policy.
7. Acceptable Use Policy
The User agrees to use the Platform in an ethical and lawful manner. In particular, the following is expressly prohibited:
- Unlawful discrimination: Using DISC Test results or Reports as a tool for employment discrimination based on race, gender, sexual orientation, religion, disability, age, nationality, or any other condition protected by applicable law.
- Redistribution or resale: Redistributing, reselling, sublicensing, or commercializing the Tests, Reports, or other Platform content to third parties without prior written authorization from QP.
- Reverse engineering: Decompiling, disassembling, reverse engineering, or attempting to extract the source code, algorithms, or operating logic of the Platform.
- Automated access: Accessing the Platform through bots, scrapers, crawlers, or other unauthorized automated mechanisms. All programmatic access must be conducted exclusively through the official API and in accordance with its terms of use.
8. Limitation of Liability
The User acknowledges and accepts the following limitations:
- Advisory nature: DISC Reports are support tools of an advisory nature. They do not constitute definitive diagnoses and should not be used as the sole criterion for making employment or personal decisions.
- Hiring decisions: QP shall not be liable for hiring, promotion, termination, or any other decisions that the Client Company or User makes based on Reports generated by the Platform.
- Liability cap: In the event of any claim, QP's total and cumulative liability to the User is limited to the amount actually paid by the User during the twelve (12) months immediately preceding the event giving rise to the claim. QP shall not be liable for indirect, incidental, consequential damages, lost profits, or loss of opportunity.
9. Personal Data Protection
QP is committed to protecting the personal data of Users and Candidates in accordance with Law No. 19,628 on the Protection of Private Life (Ley N° 19.628 sobre Protección de la Vida Privada) and other applicable regulations of the Republic of Chile.
The processing of personal data is governed by our Privacy Policy, which forms an integral part of these Terms and Conditions. The User acknowledges having read and accepted it.
To exercise the rights of access, rectification, cancellation, and opposition (ARCO rights), or to request the deletion of personal data, the User or Candidate may contact us through the channels indicated in the Contact section or through our data deletion request form.
10. Termination
The conditions for termination of the contractual relationship are as follows:
- Voluntary closure: The User may request account closure at any time through the Platform settings or by contacting our support team. Closure will be effective within five (5) business days following the request.
- Suspension for breach: QP reserves the right to suspend or cancel the User's access immediately and without prior notice in the event of a material breach of these Terms, fraudulent use of the Platform, or any conduct that jeopardizes the security or integrity of the service.
- Post-termination effects: Once the relationship has ended, the User's data will be handled in accordance with our data retention policy. Candidates' personal data will be deleted within the timeframes established in the Privacy Policy, without prejudice to the legal obligation to retain certain information for the period required by law.
11. Amendments to the Terms
QP reserves the right to amend these Terms and Conditions at any time. When amendments are material, we will notify the User by email at least thirty (30) days prior to the effective date of the changes.
Continued use of the Platform after the effective date of the amendments shall constitute acceptance of the new terms. In the event of disagreement, the User may close their account in accordance with Section 10.
12. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of the Republic of Chile, in particular Law 19,628 on the Protection of Private Life, Law 19,496 on the Protection of Consumer Rights (where applicable to Users acting as consumers), the Chilean Civil Code and the Commercial Code. For Users resident in the European Union, the General Data Protection Regulation (GDPR) also applies.
Under Law 19,496, consumer Users retain all non-waivable rights, including the right to lodge complaints with the Chilean Consumer Protection Agency (SERNAC). Nothing in these Terms shall limit the minimum rights afforded to consumers by law.
Any dispute arising from the interpretation, performance, or enforcement of these Terms shall be submitted to the Ordinary Courts of Justice of the city of Santiago, Chile, without prejudice to consumer jurisdiction where Law 19,496 so requires.
